David Memorial Garden
Rules and Regulations
The following
Rules and Regulations have been adopted by the Board of Directors of Congregation
Beth David, Saratoga, California, a religious, non-profit corporation,
owner of approximately 400 interment rights in Oak Hill Memorial Park,
San Jose, California, for the mutual protection of owners of Interment
Rights in the Beth David Memorial Garden. All owners of Interment Rights
and other persons within the Beth David Memorial Gardens, and all Interment
Rights sold therein, shall be subject to these Rules and Regulations as
they now exist and as they may reasonably be amended or altered hereafter
by the Board of Directors of Congregation Beth David.
These rules
incorporate by reference the Rules and Regulations of Oak Hill Memorial
Park, revised October 1, 1997.
Definitions
Reference
to the "Cemetery Committee" means the standing committee defined
in the bylaws of Congregation Beth David.
Reference
to the "Rabbi of Congregation Beth David" shall be to the rabbi
or rabbis charged by the Board of Directors of Congregation Beth David
with making Halakhic decisions.
Halakhic
Rules
-
Beth
David Memorial Garden is maintained and operates in accordance with
Conservative Jewish law as interpreted by the Rabbi of Congregation
Beth David. Graves will be sold only to persons of the Jewish faith.
Individuals who have converted to Judaism must present proof of conversion
in accordance with Conservative or Orthodox Jewish law.

No cremated
remains shall be buried in Beth David Memorial Garden unless death has
resulted from accidental burning. All bodies must be prepared in accordance
with Conservative Jewish law.
General
Rules
-
No interment,
disinterment, unveiling, or delivery or work of any kind shall be permitted
on Saturday or religious holidays observed by Congregation Beth David.

Disinterment
shall be permitted only in accordance with Jewish law as determined
by the Rabbi of Congregation Beth David.

Assignment
or transfer of a plot shall be subject to the written consent of the
Cemetery Committee and shall conform to the requirements specified in
these Rules and Regulations. The transferor shall be responsible for
the payment of costs assessed by the Oak Hill Cemetery and Congregation
Beth David in effect at the time of the transfer.

In the
event the Owner of interment rights moves away before interment has
been made, Congregation Beth David may agree to re-purchase the grave
site for the original purchase price, less charges as shall be assessed
by the Board of Directors of Congregation Beth David and/or Oak Hill
Cemetery.

Each
grave site is maintained by Oak Hill Cemetery and no planting of trees,
shrubs, or flowers is permitted. No decorations, artificial flowers
or other types of decorations are permitted.
Monuments
and Markers
-
Each
burial site must have a monument in place within one year of burial.
All monuments must comply with the standards established from time to
time by the Board of Directors of Congregation Beth David.

Monuments
may be traditional upright headstones, pillow stones, or ledger coverings
made from stone in the shape and color generally seen within the grounds
of the Oak Hill Cemetery.

Where
members of a family are to be buried next to one another, a double or
triple width headstone may be installed identifying the family name,
provided there is place on the front or reverse for engraving the names
of the individuals.

Monuments
may be purchased from any source; however, no monument shall be installed
without first complying with the Oak Hill Cemetery administrative requirements.

Photographs
of the deceased may be incorporated in the design of the monument provided
that the picture shall be permanently affixed as part of the design
of the monument.

No flower
vases will be permitted as permanent installations in conjunction with
a headstone or other marker.

The maintenance
and up keep of a monument is the responsibility of the heirs of the
deceased. Any monument which is damaged, whether by acts of nature or
by vandalism, or is deemed by the Cemetery Committee to have become
a hazard or unsightly shall be repaired or replaced at the heirs' expense.
